Privacy and Purchasing Policy
Ametikoolitus OÜ, registry code 12161151, address Aida 5-205, Pärnu 80010, who manages
the www.autosert.ee website and online shop, and the customer who places an order on
the www.autosert.ee website (hereinafter the Buyer) hereby enter into an agreement on
the use of the website under the following conditions.
Nature of the website
Ametikoolitus OÜ organises professional and renewal trainings for professional
drivers, vehicle category training, and other training and courses related to the
transport sector (hereinafter Trainigs).
Ametikoolitus OÜ sells work and rest time equipment, cargo safety products, and
other related goods (hereinafter the Goods).
The website www.autosert.ee is an environment created and managed by
Ametikoolitus OÜ and includes an online shop where the Buyers can register for
Trainings, pay for their participation, and purchase Goods.
General provisions
The terms and conditions of sale and purchase apply to all legal relations between
any person and the owner of the www.autosert.ee online environment (hereinafter
the Online Shop), Ametikoolitus OÜ, when purchasing Goods and registering for
Trainings via the Online Shop.
In addition to these terms and conditions, the legal relations arising from the
purchase of Goods from the Online Shop of Ametikoolitus OÜ and the registration
for Trainings is governed by the legislation in force in the Republic of Estonia.
Ametikoolitus OÜ reserves the right to make changes to the terms and conditions of
purchase and sales prices. These changes are set out on the website
www.autosert.ee.
The contract of purchase and sale between Ametikoolitus OÜ and the Buyer enters
into force from the moment of complete receipt of the amount due according to the
order confirmation on the current account of Ametikoolitus OÜ and the dispatch of
the Goods to the Buyer by the Online Shop or the sending of the registration
confirmation to the email address of the Buyer in the case of Trainings.
By placing an order and making a payment in the Autosert.ee Online Shop, the Buyer
confirms that they have read and agree to the Terms and Conditions of Purchase and
Sale.
The Buyer is responsible for the accuracy of the information provided in the order. If
the Buyer submits false information when placing an order, the Online Shop is not
liable for the consequences thereof.
If the damage arises because the Buyer has not familiarised themselves with this
policy, despite having been given the opportunity to do so, in spite of the recommendations on part of the Seller and the obligations of the Buyer,
Ametikoolitus OÜ cannot be held liable for this.
Ametikoolitus OÜ will not be liable for any damage caused to the Buyer or for any
delay in the delivery of the Goods if the damage or the delay in the delivery of the
Goods is due to a circumstance beyond the control of Ametikoolitus OÜ.
Prices
The prices of the Trainings are expressed in euros and are subject to a 20% VAT (except
for A-, B-, and BE-category training courses and their ancillary services, which are
shown inclusive of VAT).
All prices of the Goods shown in the Online Shop are in euros, without shipping
costs, and include a 20% VAT. The shopping cart of the Online Shop also indicates
the prices of the order without VAT and the shipping costs according to the choice of
the Buyer.
Information about the Goods or Events is displayed directly next to the Goods or
Trainings on the website.
If an order was placed prior to the modification of the terms and conditions of
purchase or prices, the terms and conditions in force at the time of placing the order
are applied to the legal relations between the Buyer and Ametikoolitus OÜ.
Goods: placing the order, payment, and delivery of Goods
To order the Goods, you must add the desired Goods to your shopping cart.
To place an order, you need to open the shopping cart, change the quantity of the
Goods if necessary, select the transport method, and click on the ‘Place order’
button.
In the ‘Order details’ screen that will then appear, you will need to enter the correct
details of the Buyer, select the exact delivery destination, agree to the terms and
conditions, and click on the ‘Confirm order’ link. If necessary, it is possible to add
additional information about the order.
The order will then be displayed on the screen, including the number and date, and
you can pay for it by bank transfer (Swedbank, SEB, LHV, Luminor, Coop Bank,
Citadele, Revolut). You will find the payment details on the order page displayed on
the screen after confirming the order.
The invoice is paid through Montonio Finance OÜ, using the bank links listed above.
Ametikoolitus OÜ is the controller of personal data and sends the personal data
necessary for making payments to the processor Montonio Finance OÜ.
When the order is confirmed, the summary of the order is sent to the email address
that you provided when placing the order if you wish to pay for the order later.
Outstanding orders are cancelled 7 days after placing the order.
The Goods are delivered by a DPD courier or Itella Smartpost. For the shipping costs,
please see the price list of the chosen courier. The delivery fee is displayed to the
Buyer when placing the order. Delivery terms of 1–5 working days are valid from the moment of payment of the invoice and only if the order is delivered within the
Republic of Estonia. In exceptional cases, the Goods might be delivered within 30
calendar days.
The contract enters into force upon receipt of the amount due on the current
account of Ametikoolitus OÜ.
If the ordered Goods cannot be delivered due to being out of stock or for any other
reason, the Buyer is informed as soon as possible and the money paid (including the
delivery fee of the Goods) are refunded usually within 1–2 working days. Depending
on the payment method, it can take up to 7 working days.
After the entry into force of the contract of purchase and sale (i.e. the payment of
the invoice by the Buyer), Ametikoolitus OÜ assembles the order and delivers it to
the supplier chosen by the Buyer: Itella Smartpost or DPD courier.
The accuracy and correctness of the information provided in the order will prevent
delays and misunderstandings in the delivery of the Goods. Ametikoolitus OÜ cannot
be held responsible for delays in the delivery of the Goods and for
misunderstandings that arise if the delay or misunderstanding is due to inaccurate
information provided by the Buyer when placing the order.
In the event of visible damage to the packaging, the Buyer is advised not to accept
the Goods but to return them to the courier. By signing the delivery note of the
Goods, the Buyer confirms that the packaging was intact or that they were satisfied
with the condition of the packaging when receiving the Goods.
The Buyer must also inform Ametikoolitus OÜ of returning the Goods to the courier
by sending a notice to the email address of the Online Shop info@autosert.ee.
Ametikoolitus OÜ has the right to withdraw from the sales transaction and reclaim
the Goods from the Buyer if the price of the Goods in the Online Shop is marked
significantly below the market price of the Goods due to a mistake.
Ametikoolitus OÜ will not be liable for any delay in the delivery of the Goods if the
Goods are delivered to the logistics partners in time, by the delivery date promised
to the Buyer, but the delay in delivery is due to circumstances that Ametikoolitus OÜ
could not influence or foresee.
Placing an order and payment for Trainings
To place an order and register for a Training, you must:
select the appropriate course from the website;
click on the ‘Register’ link next to the Training;
fill in the order form with the correct details of the participant;
indicate the details of the invoice recipient;
choose the payment method (cash at a customer service point, bank transfer, bank
link, or instalments);
accept the terms and conditions;
click on the ‘Confirm order’ link, after which a confirmation of registration will be
sent to the email address of the recipient.
The invoice is displayed on the screen and it can be paid by bank transfer
(Swedbank, SEB, LHV, Luminor, Coop Bank, Citadele, Revolut).
The invoice is paid through Montonio Finance OÜ, using the bank links listed above. Ametikoolitus OÜ is the controller of personal data and sends the personal data
necessary for making payments to the processor Montonio Finance OÜ.
Ametikoolitus OÜ will send to the Buyer an email with the order confirmation about
the payment of the order. If the order confirmation contains mistakes (unwanted
Trainings, wrong participants, etc.), the Buyer must immediately contact the customer
service of Ametikoolitus OÜ at info@autosert.ee.
Ametikoolitus OÜ will not be liable for any damage or any other consequences
arising from incorrect data provided by the Buyer when filling the order.
Return and exchange of Goods
The characteristics of each product sold are set out in the description of that
product.
Pursuant to subsection 56 (1) of the Law of Obligations Act, the Buyer may withdraw
from the contract within 14 days of receiving the Goods. The right of withdrawal
does not apply if the Buyer is a legal person.
If the returned/exchanged Goods have been used or damaged by the Buyer (i.e. they
have mechanical or other damage and the original packaging is missing),
Ametikoolitus OÜ has the right to reduce the returnable fee in part or in full,
according to the decrease in the value of the Goods compared to the market price of
the Goods.
When returning or exchanging the Goods, the proof of purchase (payment
confirmation) must be presented; the Online Shop has the right to refuse to accept
the Goods returned by the Buyer if the proof of purchase is missing.
Ametikoolitus OÜ cannot be held liable for damage to the Goods caused by the fault
or negligence of the Buyer; for defects caused by the improper use of the Goods; for
natural physical wear and tear of the Goods during normal use.
Exchange of Goods
If the Goods have to be exchanged, a free-form application must be sent to
info@autosert.ee within 14 days of receipt of the Goods, indicating the details of the
Buyer, the order number and date, the name of the Goods, the link to the
replacement Goods, and the reasons for the need for exchange. You will receive a
reply within 1–3 working days.
The Goods can be exchanged free of charge if the value of the Goods exceeds €50.
If the value of the Goods to be exchanged is less than €50, the cost of return is borne
by the Buyer. In this case, the Online Shop will bear the shipping costs of the
replacement Goods.
Exchanging the Goods outside Estonia takes place at the Buyer’s expense.
Return of Goods
If the Goods are unsuitable, a free-form application must be sent to
info@autosert.ee within 14 days of receipt of the Goods, stating the details of the Buyer, the order number and date, the reason of return, and the bank account
number and the name of the holder to whom the refund should be made. You will
receive a reply within 1–3 working days.
Upon receipt of the returned Goods, the Online Shop must return to the Buyer
without undue delay, but not later than 14 days from the date of receipt of the
withdrawal application, all payments received from the Buyer under the contract.
The Online Shop may refuse to make refunds until the Goods that are the object of
the contract have been returned or until the Buyer has provided proof that they
have returned the Goods, whichever is earlier.
The Goods can be returned free of charge if the reason for the return is non-
conformity with the order or faulty Goods.
The Goods can be returned free of charge if the value of the Goods is more than €50
and the request for return is submitted within 1–3 days of receipt of the Goods.
Returns at the expense of the Online Shop can only be made from Itella SmartPOST
and DPD parcel machines.
If the value of the Goods to be returned is less than €50, the cost of return is borne
by the Buyer.
If the return of the Goods is formalised more than 3 days after the receipt of the
parcel, the Buyer will bear the return costs.
Return outside Estonia takes place at the Buyer’s expense.
If necessary, Ametikoolitus OÜ will provide further instructions for the return after
the return application has been submitted.
Right of withdrawal and re-registration for Trainings
Cancellation is possible up to 14 calendar days prior to the Training (100% of the fee
will be refunded to the Buyer) and partial cancellation up to 7 calendar days prior to
the Training (50% of the fee will be refunded to the Buyer). The fee is non-refundable
to the Buyer and the invoice is due if less than 3 days remain until the Training.
To withdraw from an order, the Buyer must submit a request to Ametikoolitus OÜ by
email (info@autosert.ee), indicating the name and date of the Training and the name
of the participant that they wish to withdraw.
To re-register an order, a free-form application must be sent to info@autosert.ee at
least 14 calendar days prior to the Training, indicating the details of the Buyer, the
number and date of the order, the name of the Training, the link to the replacement
Training, and the reason for the re-registration. You will receive a reply within 1–3
working days.
In the case of a re-registration request sent at least 14 days prior to the Training, the
participation fee for the previous order will be refunded to the Buyer and a new
invoice will be issued for the registration of the new Training.
The participation fee will not be refunded in the case of force majeure if the
organisation of the Training is not possible due to force majeure.
Force majeure is an unforeseeable circumstance beyond the control of the parties to the contract that could not have been influenced or prevented by the parties and that prevents the
performance of the obligations under the contract.
Force majeure
Ametikoolitus OÜ will not be liable for any damage caused or a delay in the delivery of the
Goods or a change in the time or place of a Training or the cancellation of a Training due to
circumstances that Ametikoolitus OÜ could not influence or foresee.
Claims
The Online Shop of Ametikoolitus OÜ is subject to the two-year time limit for filing a
claim under subsection 218 (2) of the Law of Obligations Act.
In the event of a defect, the Buyer has the right to contact the Online Shop within
two months at the latest by sending an email to info@autosert.ee.
Ametikoolitus OÜ will not be liable for any defects that have arisen after the delivery
of the Goods as a result of the consumer’s action or inaction (misuse, accident, etc.)
or in the case of normal wear and tear caused by the normal use of the Goods.
Pursuant to subsection 222 (1) of the Law of Obligations Act, if the Goods do not
conform to the contract, the Buyer may demand the repair or replacement of the
Goods, i.e. if the Goods purchased from the Online Shop (www.autosert.ee) have
defects, Ametikoolitus OÜ must repair or replace the defective Goods and if the
Goods cannot be repaired or replaced, Ametikoolitus OÜ must refund to the Buyer
all fees incurred under the sales contract. Ametikoolitus OÜ will respond to the claim
of the consumer in writing or in a format that can be reproduced in writing within 15
days.
Settlement of disputes
If the Buyer has any complaints about the Online Shop, they should be sent by email
to info@autosert.ee.
If the Buyer and the Online Shop are unable to resolve the dispute by agreement,
the Buyer can refer the dispute to the Consumer Disputes Committee, which is
competent to resolve disputes arising from the contract between the Buyer and the
Online Shop. The review of the Buyer’s complaint in the committee is free of charge.
In case of a claim, the Buyer has the right to contact the ODR platform for consumer
disputes in the European Union.
Privacy
By using the Online Shop and by visiting the site of Ametikoolitus OÜ, you give your
informed consent to Ametikoolitus OÜ to process your personal data.
Ametikoolitus OÜ processes the personal data provided by the Buyer in accordance
with the requirements established by applicable law and always proceeds from the
interests, rights, and freedoms of the Buyer when processing personal data.
Ametikoolitus OÜ aims to ensure the responsible processing of personal data in
accordance with best practice.
All processes, instructions, procedures, and activities related to the processing of
personal data by Ametikoolitus OÜ are based on the following principles:
Fairness. The processing of personal data is fair, in particular by requiring that the
Buyer is provided with adequate information on how the personal data is processed;
Transparency. The processing of personal data is transparent for the Buyer;
Lawfulness. There is a legal basis for the processing of personal data;
Purpose limitation. Personal data is collected for specified, explicit, and legitimate
purposes and not further processed in a manner that is incompatible with those
purposes;
Minimisation. Personal data is adequate, relevant, and limited to what is necessary
for the purposes for which it is processed. When processing personal data,
Ametikoolitus OÜ follows the principle of minimum processing and if the personal
data is no longer necessary or relevant for the purpose for which it was collected,
the personal data is deleted;
Accuracy. The personal data is accurate and, where necessary, kept up to date; every
reasonable step is taken to ensure that personal data that is inaccurate for the
purposes for which it is processed is erased or rectified as soon as possible;
Integrity and confidentiality. Personal data is processed in a manner that ensures
appropriate security of the personal data, including protection against unauthorised
or unlawful processing and against accidental loss, destruction, or damage, using
appropriate technical or organisational measures;
Storage limitation. Personal data is kept in a form which permits identification of the
Buyer for no longer than is necessary for the purposes for which the personal data is
processed.
The personal data processed is the data requested from the Buyer at the time of
concluding the agreement (given name and surname, profession, company,
telephone number, email address, bank account number). The processing of
personal data is necessary for the performance of a contract entered into with the
data subject.
If the Buyer has agreed to the Privacy and Purchasing Policy of Ametikoolitus OÜ,
Ametikoolitus OÜ will also process the personal data of the Buyer for the purpose of
presenting marketing materials and offers. In this case, the legal basis for the
processing of the data is the consent of the Buyer.
The data controller of the personal data of the Buyer is Ametikoolitus OÜ, Aida 5-
205, Pärnu 80010.
Ametikoolitus OÜ will not disclose the personal data of the Buyer to third parties,
except in the following cases:
to the provider of the email forwarding service in cases where Ametikoolitus OÜ
sends marketing materials and offers to the Buyer;
to the developer of the online environment to the extent necessary for ensuring the
smooth functioning of the online environment;
Ametikoolitus OÜ sends the personal data necessary for making payments to the
processor Montonio Finance OÜ.
The personal data of the Buyer is stored indefinitely until the Buyer withdraws their
consent for Ametikoolitus OÜ to process personal data for the purpose of sending
promotional offers.
The Buyer has the right to review or modify their data or withdraw their consent at
any time by sending a prior written notice to the email address info@autosert.ee.
